NOTICE OF TRUSTEE’S SALE
WHEREAS, default has occurred in the performance of the covenants, terms, and conditions of a Deed of Trust Note dated July 2, 2004, and the Deed of Trust of even date securing the same, recorded July 2, 2004, in Book No. 348, at Page 657,   in Office of the Register of Deeds for Hardin County, Tennessee, executed by Linda Henry, conveying certain property therein described to W. Lee Lackey as Trustee for Mortgage Electronic Registration Systems, Inc., as nominee for Decision One Mortgage Company, LLC., its successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by U.S. Bank Trust, N.A., as Trustee for LSF9 Master Participation Trust.
NOW, THEREFORE, notice is hereby given that the entire indebtedness has been declared due and payable; and that an agent of Wilson & Associates, P.L.L.C., as Successor Trustee, by virtue of the power, duty, and authority vested in and imposed upon said Successor Trustee, by U.S. Bank Trust, N.A., as Trustee for LSF9 Master Participation Trust, will, on February 6, 2017 on or about 2:00 PM, at the Hardin County Courthouse, Savannah, Tennessee, offer for sale certain property hereinafter described to the highest bidder FOR certified funds paid at the conclusion of the sale, or credit bid from a bank or other lending entity pre-approved by the successor trustee. The sale is free from all exemptions, which are expressly waived in the Deed of Trust, said property being real estate situated in Hardin County, Tennessee, and being more particularly described as follows:
BEING certain property in the Fourth Civil District of Hardin County, Tennessee, and said property is more particularly bounded and described as follows: BEING in the west margin of Rhonda Drive, the same being the southeast corner of the property previously conveyed by David Williams, Et ux, to Jack Wilson and wife, Sharron M. Wilson, on April 8, 1972; thence West with Wilson’s south boundary line 225 feet to a fence, the same being Wilson’s southwest corner; thence with said fence South 235 feet to a point; thence East 225 feet to the west margin of Rhonda Drive; thence with the west margin of Rhonda Drive, 235 feet to the point of beginning. Included in the above description, but excluded herefrom is the northern 100 feet to said property as described in the Deed of Edwin Ledbetter, Clerk & Master, to David Ray Williams and wife, dated December 3, 1974, and recorded in the Register’s Office for said County in Deed Book 78, Page 160, and reference is here made to said Deed, and to the Book and Page where recorded, for a complete and accurate description of said property, not the exclusion.

This sale is subject to all matters shown on any applicable recorded plat; any unpaid taxes; any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; any prior liens or encumbrances as well as any priority created by a fixture filing; and to any matter that an accurate survey of the premises might disclose. Gibbs and Crystal Gibbs, conveying certain property therein described to Andrew C. Rambo as Trustee for Mortgage Electronic Registration Systems, Inc., as nominee for First Community Mortgage, Inc., its successors and assigns; and the undersigned, Wilson & Associates, P.L.L.C., having been appointed Successor Trustee by PennyMac Loan Services, LLC.

Parcel One: Beginning at a point in the center of Barker Drive, the same being the Northeast corner of the tract which this is a part and being the Northwest corner of a tract conveyed to Jena Stout by deed recorded in Deed Book 127, page 825 in the Register’s Office of Hardin County; runs thence South 4 degrees 30 minutes West, along and with the West boundary of said Stout tract a distance of 167.20 feet to an iron pin, said iron pin being the Southeast corner of the tract this is a part and the Southwest corner of said Stout tract; runs thence North 87 degrees 25 minutes West a distance of 52.25 feet to a point; runs thence North 4 degrees 30 minutes East a distance of 169.60 feet to a point in the center of Barker Drive; runs thence South 85 degrees 15 minutes East along and with center of Barker Drive, a distance of 52.50 feet to the point of beginning and containing 0.204 acres, more or less. (Description according to prior deed.) Included in the description but excluded herefrom is the legal right of way for Barker Drive. Parcel Two: Beginning at a point in the center of Barker Drive, the same being East 110 feet from the Northwest corner of the tract of which this is apart; runs thence East with the center of said Barker Drive 107.5 feet to a point; runs thence South 4 degrees 30 minutes West 160 feet to an iron pin in the South boundary of the tract of which this is a part; runs thence North 84 degrees West 107.5 feet to a point; runs thence North 4 degrees 30 minutes East 160 feet to the point of beginning.
