TRUSTEE’S NOTICE OF SALE
Default having been made in the payment of the debts and obligations secured to be paid by a certain deed of trust executed by Lynn Churchwell on the 29th day of October, 1996, to W. Lee Lackey, Trustee, as same appears of record in the Register’s Office of Hardin County, Tennessee, in Book 10Y, page 41, as modified in Record Book 370, page 337, and the note and Deed of Trust having been assigned to James F. McKinnie by Assignment recorded in Record Book 462, page 744, and  Dale Bohannon having been appointed Substitute Trustee per instrument recorded in Record Book 659,  page 83; and James F. McKinnie being the owner and holder of the debt secured, having requested the undersigned to advertise and sell the property described in and conveyed by the said deed of trust, all of the said indebtedness having matured by default in the payment of a part thereof, this is to give notice that the undersigned will on February 28, 2017 commencing at 2:00 p.m., at the east door of the Hardin County Courthouse, 465 Main Street, Savannah, Tennessee, proceed to sell at public outcry to the highest and best bidder for cash, the following described tract of property, to-wit:
Tract 1:  BEGINNING at a stake in the south right-of-way line of U.S. Highway No. 64, the same being the northeast corner of the lands of James W. Jones and the northwest corner of the lands herein described, and runs thence East with the south right-of-way line of said highway 400 feet to a large cedar post near a utility pole in the same; thence South 300 feet to a large cedar post in a fence corner; thence West with said fence 400 feet to an iron stob and a large cedar post in the east boundary line of the lands of James W. Jones; thence North with Jones’ west boundary line and the west boundary line of the lands herein described 300 feet to the point of beginning, containing a lot running East and West 400 feet and North and South 300 feet, the same containing approximately 2.7 acres, more or less.  Said Lot is generally bounded on the north by U.S. Highway No. 64, on the south and east by the lands of a.A. Gillham and wife, Lillie Gillham, and on the west by the lands of James W. Jones. 
The previous and last conveyance and/or Grantors’ source of equitable interest for the property hereinabove described is: By a Warranty Deed from Roy Crunk, et ux, recorded in Warranty Deed Book 127, page 532 in the Register’s Office of Hardin County, Tennessee.
Tract 2:  BEGINNING at a flat iron in a fence corner in Jones’ south boundary line, the same being the northeast corner of F & B Asphalt Plant, and the northwest corner of the tract herein described; thence South 02 degrees 30 minutes West with fence line, F & B Asphalt Plant’s east boundary line, 593.2 feet to an iron pin; thence North 89 degrees 04 minutes 40.1 seconds East 427.52 feet to an iron pin; thence North 02 degrees 18 minutes 52.7 seconds East 634.95 feet to a fence corner; thence South 83 degrees 30 minutes West with fence line, Churchwell’s south boundary line, 430 feet to the beginning, containing 6.0 acres, more or less. 
The previous and last conveyance and/or Grantors’ source of equitable interest for the property hereinabove described is: By a Warranty Deed from Lillie Gilliam, recorded in Warranty Deed Book 148, page 478 in the Register’s Office of Hardin County, Tennessee.
Included in the first above description, but excluded herefrom is a .147 acre tract taken by the State of Tennessee for right-of-way purposes by Decree, a certified copy of which is of record in the Register’s Office for Hardin County, Tennessee, in Deed Book 176, page 400. 
The street address of the above-described property is believed to be 2220 and 2720 Highway 64, Crump, TN   38327, but such address is not part of the legal description of the property sold herein and in the event of any discrepancy, the legal description referenced herein shall control.
Said sale shall be subject to any unpaid property taxes, to any additional prior, liens, leases, encumbrances, to any rights of redemption not heretofore expressly waived, and to all applicable reservation of minerals, easements, rights-of-way, setback lines and restrictions.
Such property is subject to Notices of Federal Tax Lien in favor of the United States, of record in Record Book 334, page 841, Record Book 521, page 66, and Record Book 526, page 584, Register’s Office for Hardin County, Tennessee.  Notice of said sale required by 26 U.S.C. Section 7425(b) to be given to the United States has been timely given, and said sale will be subject to the right of the United States to redeem such property, as provided in 26 U.S.C. Section 7425(d)(1).
OTHER INTERESTED PARTIES:
Tenant(s) rights in possession, if any, Community South Bank, Union Planters Bank and Georgia Ann Churchwell. 
Such property is subject to junior mortgages to Union Planters Bank recorded in Record Book 244, page 860 and Record Book 209, page 684, in the Register’s Office for Hardin County, Tennessee.
The equity of redemption, homestead, statutory right of redemption, dower and all other  exemptions of every kind are waived in said deed of trust, and the title is believed to be good, but the undersigned will sell and convey only such title as he may convey as Trustee there being no representations or covenants of warranty of title made hereby.
Terms of sale: Cash.
It will be the responsibility of the successful bidder to obtain possession of the property at his expense, and any damage, vandalism, theft, destruction, or other loss or damage to the property occurring subsequent to the date of sale shall be at the risk of the successful bidder.
The Trustee reserves the right to postpone or set over the date of sale in the event the Trustee deems it best for any reason at the time of sale by announcement to postpone or continue this sale from time to time without further publication and with such notice of postponement as deemed reasonable by the Trustee.  In the event the highest bidder at such sale fails to complete his purchase of the subject real property within the applicable time allowed, the undersigned Trustee reserves the right to complete the sale of the subject real property, without further notice or advertisement, to the next highest bidder who is able to consummate his purchase of the property within the time permitted by the Trustee.
