NOTICE OF SUBSTITUTE TRUSTEE’S SALE
WHEREAS, JESSE ALAN JARRETT and wife, SUMMER RENEE JARRETT, by Deed of Trust dated February 16, 2011, of record in Record Book 531, Page 344, Register’s Office for Hardin County, Tennessee, conveyed to MARTIN HAGGARD, JR., Trustee, the hereinafter described real property to secure the payment of a certain Promissory Note described in the Deed of Trust, which Note was payable to WAYNE COUNTY BANK;
 WHEREAS, JOE L. BROWN having been appointed Substitute Trustee by the owner and holder of the Note by an instrument of record in Record Book 661, Page 255, dated
February 24, 2017 in the Register’s Office for Hardin County, Tennessee;
WHEREAS, the owner and holder of the Note has demanded that the hereinafter described real property be advertised and sold in satisfaction of indebtedness and costs of foreclosure in accordance with the terms and provisions of the Note and Deed of Trust.
NOW, THEREFORE, notice is hereby given that I, JOE L. BROWN, Substitute Trustee, pursuant to the power, duty and authority vested in and conferred upon me, by the Deed of Trust, will on May 4, 2017, at 10:00 a.m. at the East door of the Hardin County Courthouse in Savannah, Tennessee, offer for sale to the highest bidder for cash, and free from all legal, equitable and statutory rights of redemption, exemptions of homestead, rights by virtue of marriage, and all other exemptions of every kind, all of which have been waived in the Deed of Trust, certain real property located in Hardin County, Tennessee, described as follows:
Description: Beginning at a PK nail found in the center of Coy Hill Road (E026) being the southeast corner of parent tract and the northeast corner of Edwin and Maxine Kier (DB 175, page 343). Thence along the center of Coy Hill Road, N 16 12 56 W for 34.16 feet to a mag nail set, being the TRUE POINT OF BEGINNING and the southeast corner of described lot. Thence leaving said road, along a new severance line parallel to the south line of parent tract, S 85 27 57 W passing a half inch iron pin set at 25.00 feet for a total distance of 196.00 feet to a half inch iron pin set, being the southwest corner of described lot, N 41 58 34 W for 40.19 feet to a half inch iron rod set, N 03 58 41 W for 132.92 feet to an iron pin found being the northwest corner of described lot, an interior corner of parent tract, and the southwest corner of Mark Franks (DB 192, page 388). Thence along the south line of Franks south 87 05 44 E passing an iron pin found at 176.95 feet for a total distance of 201.99 feet to a PK nail found in the center of Coy Hill Road. Being the northeast corner of described tract and the southeast corner of Franks. Thence along the center of Coy Hill Road, S 06 36 30 E for 35.59 feet, S 12 31 34 E for 57.05 feet, S 16 12 56 E for 47.59 feet to the point of beginning, containing 0.714 acres. Subject to the west prescriptive margin of Coy Hill Road (0.080) and existing utility easements. Description according to a survey by Dale E. Sagely TN RLS#1888 dated July 14, 2003, using a Wild T 1000 instrument with a closure II category survey and record north bearing.
RETAINED WATERLINE & UTILITY EASEMENT – Expressly retained herein is an easement to allow a waterline to remain on the southeast corner of the property conveyed herein and further to allow a waterline to remain with 10 feet of the south boundary of the property conveyed herein. Also retained is the right for a power line and telephone line to remain on the north portion of the property conveyed herein. Both easements shall be for the benefit of the grantor and his heirs, successors, and assigns, and be perpetual and a real covenant running with the land.
Also conveyed herein is a 1988 Pace Mobile Home, VIN # ALFRC3874647.
Being the same property conveyed to Jesse Alan Jarrett and wife, Summer Renee Jarrett by deed of Sherry Franks, dated February 16, 2011 and recorded in Record Book 531, Page 322, in the Register’s Office for Hardin County, Tennessee.
