NOTICE OF SUBSTITUTE TRUSTEE’S SALE
WHEREAS, by deed of trust dated the 15th day of July, 1999, of record in the Register’s Office for Hardin County, Tennessee, in Record Book 201, page 521, JANETTE B. WICKER did convey her interest in trust to W. Lee Lackey, Trustee, in and to certain realty hereinafter described to secure the payment of the promissory note payable to the order of CENTRAL BANK, and
WHEREAS, said deed of trust provides that in the event the trustee appointed therein cannot serve in such capacity the holder of the note may appoint a Substitute Trustee, and by instrument dated February 13, 2018, and recorded in Record Book 682, page 368 in the Register’s Office of Hardin County, Tennessee, the holder of the note appointed J. Gilbert Parrish, Jr. as Substitute Trustee; and
WHEREAS, said deed of trust further provides that in the event of default in the payment of said note and interest when due the entire indebtedness shall, at the option of the holder and owner thereof, become due and payable, and
WHEREAS, default has been made in the payment of certain installments of said note now due, and the holder and owner of said note, CENTRAL BANK has declared the entire amount due and payable and has instructed the undersigned trustee to foreclose on said deed of trust.
NOW, THEREFORE, by the virtue of the authority vested in me as said Trustee under said instrument, I will on the 20th day of March, 2018, offer for sale and will sell in front of the East Door of the Courthouse in Savannah, Tennessee, at the hour of 10:00 o’clock a.m. to the last, highest and best bidder for cash in hand and in bar of the equity of redemption on the following described tract of land situated in Hardin County, Tennessee, and particularly described as follows:
Beginning at an iron pin found in the North right of way line of Long Street, marking the southwest corner of the subject and the southeast corner of Blanch White property described in Deed Book 123, page 474, Register’s Office of Hardin County; thence leaving said road and running with the East line of White, North 08 degrees 34 minutes 25 seconds East 122.46 feet to an iron pin at a fence corner, being a point in the South line of Tom Haggard property described in Deed Book 156, page 581, Register’s Office of Hardin County; thence running with a fence and the South line of Haggard, South 82 degrees 37 minutes 01 seconds East 74.89 feet to an iron pin at a fence intersection, said point marking the northwest corner of Luther Cary property described in Deed Book 169, page 353 in the Register’s Office of Hardin County; thence running with a fence and the west line of Cary, South 09 degrees 25 minutes 30 seconds West 121.17 feet to an iron pin found in the North right of way line of said Long Street; thence running with said right of way line, North 83 degrees 40 minutes 01 seconds West 73.12 feet to the point of beginning, containing 0.207 acres, and being Lots 26, 27 and 28, Section A of Perry-Long Subdivision, a plat of which is recorded in Deed Book 28, page 414 in the Register’s Office of Hardin County.
Being the same property conveyed to Janette B. Wicker by deed of Kenneth N. Gray dated July 15, 1999 and recorded in Record Book 201, page 518 in the Hardin County Register’s Office.
Said property is also subject to the lien of the 2006-2017 county taxes, 2006-2017 city taxes, and further subject to the building and use restrictions affecting the Perry Long subdivision as shown in Deed Book 28, page 414 in the Hardin County Register’s Office.
The following subordinate lienholder has been notified by certified mail:
All rights and equity of redemption, statutory and otherwise, homestead and dower are expressly waived in said deed of trust, and the title is believed to be good, but the undersigned will sell and convey only as trustee.
