WHEREAS, said deed of trust provides that in the event the trustee appointed therein cannot serve in such capacity the holder of the note may appoint a Substitute Trustee, and by instrument dated April 10, 2018, and recorded in Record Book 685, Page 826 in the Register’s Office of Hardin County, Tennessee, the holder of the note appointed Katie P. Hagenbrok as Substitute Trustee; and
WHEREAS, said deed of trust further provides that in the event of default in the payment of said note and interest when due the entire indebtedness shall, at the option of the holder and owner thereof, become due and payable, and
WHEREAS, default has been made in the payment of certain installments of said note now due, and the holder and owner of said note, LAND IS FOREVER TRUST, has declared the entire amount due and payable and has instructed the undersigned trustee to foreclose on said deed of trust.
WHEREAS, notice was given as required under T.C.A. § 35-5-101, et seq. and/or T.C.A. § 67-1-1433, as applicable.
NOW, THEREFORE, by the virtue of the authority vested in me as said Trustee under said instrument, I will on the 16th day of May, 2018, offer for sale and will sell in front of the East Door of the Courthouse in Savannah, Tennessee, at the hour of 9:00 o’clock A.M. to the last, highest and best bidder for cash in hand and in bar of the equity of redemption on the following described tract of land situated in Hardin County, Tennessee, and particularly described as follows:
BEGINNING at a metal pin in the center of Childer’s Hill Road, the same bring the northeast corner of Gordon Johnson and the southeast corner of the tract herein described; thence along the center of said road and the north boundary line of Gordon Johnson, North 66 degrees 26 minutes West 245.9 feet to a metal pin in the center of said road; thence North 0 degrees 43 minutes West 255.9 feet to a stake, the same being the northwest corner of the tract herein described; thence East 224.4 feet to a stake; thence South 0 degrees 43 minutes East 356.01 feet to the point of beginning and containing 1.5 acres more or less.
Being the same property conveyed to Brian Lambert by deed of Nicholas Johnson dated January 11, 2012, and recorded in Record Book 549, page 473, in the Register’s Office of Hardin County, Tennessee.
All rights and equity of redemption, statutory and otherwise, homestead and dower are expressly waived in said deed of trust, and the title is believed to be good, but the undersigned will sell and convey only as trustee.
This sale is subject to all matters shown on any applicable recorded plat, and unpaid taxes, and any restrictive covenants, easements, or setback lines that may be applicable; any statutory rights of redemption of any governmental agency, state or federal; and any prior liens or encumbrances having priority over the Trust Deed. In addition, the following parties may claim an interest in the above-referenced property: Tennessee Department of Revenue. Said property is subject to the right of the State of Tennessee to redeem the property as set forth in T.C.A. § 67-1- 1433(c)(1).
The Substitute Trustee reserves the right to make oral announcements at the time of the public sale which shall apply to the terms of the sale. The Substitute Trustee may postpone any sale hereunder to another time or place by announcement to all present at the time and place of the sale scheduled herein, without the necessity of any further notice.
THIS IS AN ATTEMPT TO COLLECT A DEBT AND ANY INFORMATION OBTAINED WILL BE USED FOR THAT PURPOSE.
